Payment Schedule

Placement of order 15%

Hull fabrication to deck level 25%

Aluminium fabrication completed 25%

Motor fitted to transom 25%

Successful sea trials in Albany 10%

Price Increase

Westerberg marine will hold this contract valid and the price firm for a period of no longer than three calendar months from the date of signed Agreement unless otherwise agreed in writing. Should any increase in costs be experienced prior to construction commencement, the customer will be notified, and any variation in costs will be advised and adjusted accordingly.

Retention of Title

Property ownership in the goods supplied by Westerberg Marine to a purchaser, does not pass to the purchaser until those goods have been paid for in full. The purchaser irrevocably authorizes Westerberg Marine to enter upon any premises upon which their goods are stored to inspect or reclaim the goods in the event that the purchaser has not made payment in full.

Warranty of manufacturer

Westerberg Marine will repair or replace any part of the hull, which is proven to be defective under normal use, within five years from delivery of goods to the purchaser.

This warranty does not apply to:

a)      Paints, fabrics, chromium plated, aluminium and stainless-steel finish due to the varying affect resulting from different climatic and use conditions.

b)      All products not manufactured by Westerberg Marine, including engines and pumps. Any warranty provided by manufacturers or suppliers of equipment, products and accessories carrying their own individual warranties, will be passed on to the purchaser.

c)       Installation of equipment by any other person.

d)      Parts, which have been altered, in a manner, which has impaired the original characteristics of the vessel.

e)      Owners of the vessel, other than the first owner to whom Westerberg Marine deliver the vessel.

Goods supplied by Westerberg Marine to the purchaser shall be at the purchaser’s risk immediately upon delivery to the purchaser’s custody and/or direction from the workshop premises at 5 Princess Royal Drive, Albany. The purchaser shall insure the goods from the time of delivery from Westerberg Marines workshop, at their cost, against such risks, as they consider appropriate.
